Terms of service
Last updated: 31 October 2026
1. Scope
These terms apply to all Shopify apps of Mercurio Labs, Levent Yakin, Paulsborner Straße 91, 10709 Berlin, Germany ("we"), currently Mercurio Art Wall. They apply between us and the business that installs an app in its Shopify store ("you"). Our apps are offered to businesses only, not to consumers. Shopify's own terms for merchants and for the Shopify App Store apply in addition.
2. The service
The app and its functions are described in its Shopify App Store listing and in our help pages. We may improve and change the app as long as its main functions stay available. We aim for high availability but cannot guarantee uninterrupted operation; maintenance, outages of Shopify or of our hosting provider may cause interruptions.
3. Plans, trial and billing
- The app has a free plan and paid plans. Prices and the functions of each plan are shown in the app and in the App Store listing.
- Each store can try paid plans once for 14 days at no cost.
- Paid plans renew monthly or yearly until cancelled. Shopify charges the fees on your Shopify bill; Shopify's billing terms apply.
- You can change plans or cancel at any time in the app or by uninstalling it. Fees already paid are not refunded, except where Shopify's rules or the law require it.
- We may change prices with at least 30 days' notice. The new price applies from your next billing period; you can cancel before it takes effect.
- If you move to a lower plan, your settings are kept; functions outside the plan are switched off in the storefront until you upgrade again.
4. Your responsibilities
- You are responsible for the products, images, prices, discounts and texts you show with the app, and for having the rights to them.
- You check that sizes, frames and discounts shown in the designer match your offer before you publish it.
- You inform your customers about the app in your store's privacy policy where required. Our privacy policy describes what the app processes, and we provide a data processing agreement on request.
- You do not use the app in a way that breaks the law or Shopify's rules, and you do not try to break, overload or copy it.
5. Rights of use
For the duration of the installation you get a simple, non-transferable right to use the app for your store. All rights in the app remain with us. You keep all rights in your content; you allow us to process it as far as needed to run the app for you.
6. Discounts and prices in your store
Set discounts are created as discounts in your Shopify store. Shopify calculates the final price at checkout. We are not liable for orders placed at a price or discount that you configured.
7. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence we are liable only for breach of an essential contractual obligation (an obligation whose fulfilment makes the contract possible and on which you may rely), limited to the damage typical and foreseeable for this kind of contract. Otherwise our liability for slight negligence is excluded. For the free plan, we are liable only for intent and gross negligence, except for injury to life, body or health.
8. Term and termination
The contract starts with the installation and ends with the uninstallation. We may end it with 30 days' notice, or immediately for good cause, for example a serious breach of these terms. After uninstallation we delete your store's data as described in our privacy policy.
9. Changes to these terms
We may change these terms for good reason, for example new functions or changed law. We will inform you at least 30 days in advance in the app or by email. If you keep using the app after that date, the new terms apply; if you disagree, you can uninstall the app before then.
10. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a merchant (Kaufmann), a legal entity under public law or have no general place of jurisdiction in Germany, the place of jurisdiction is Berlin. If a provision is invalid, the rest of these terms remains valid.
